The pandemic has forever changed the landscape of how and where we work. A recent Ipsos poll found that only half of Canadians currently working from home expect to return to the office regularly in 2022. This has left employers scrambling to find ways to supervise and measure the productivity of employees working remotely.

This presentation reviews some of the latest technologies being used to monitor employees and consultants (a.k.a. “bossware”) and examines the associated privacy and employment law issues. It will also focus on Bill 88, the Ford Government’s recently passed Working for Workers Act, 2022, which requires employers to tell employees if, how, and in what circumstances, they are being monitored electronically. The presentation will provide a landscape of the implications for employers stemming from the Bill’s mandatory disclosure obligations and best practices that organizations should consider when implementing electronic monitoring programs in the workplace.
